TrustOffice is operated by AgenticTrust. TrustOffice respects the intellectual property rights of others and expects users of our Services to do the same. This policy describes how to report copyright infringement on the TrustOffice website at trustoffice.app and the TrustOffice web application at app.trustoffice.app (together, the "Services") in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512.
1. Reporting copyright infringement
If you believe that content on or accessible through the Services infringes your copyright, please send a written notice (a "DMCA Notice") to our copyright agent at the contact information below. Your notice must include the following information as required by 17 U.S.C. Section 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the specific material on the Services that you claim is infringing, including the URL or other location information sufficient to locate it.
- Your contact information, including your full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
2. How we respond to DMCA notices
When we receive a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted it. We will also keep a record of the notice as required by law.
3. Counter-notice
If you believe that your content was removed in error or misidentification, you may submit a counter-notice. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located (or the District of Utah if your address is outside the United States), and that you will accept service of process from the person who filed the original DMCA notice or their agent.
If we receive a valid counter-notice, we may restore the removed material within 10 to 14 business days unless we first receive notice from the original complainant that they have filed a court action seeking to restrain the infringement.
4. Repeat infringers
We will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances, as required by 17 U.S.C. Section 512(i).
5. Bad-faith notices
Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from parties who submit bad-faith DMCA notices or counter-notices.
